These terms govern access to the FusorX website, synthetic public Power Yield sample, and inquiry form. Customer workspaces, paid services, field assessments, pilots, handling of sensitive facility information, and operational deployments require separate written terms appropriate to the engagement.
1. Limited public access licence
FusorX grants a limited, revocable, non-exclusive, non-transferable licence to view and use the public website and sample for evaluation. No ownership right, commercial licence, right to reproduce protected software or model logic, or right to use the public sample for operational control is transferred.
2. Public-sample boundary
The public Power Yield experience is deliberately limited. Values are synthetic or illustrative, and the public deployment does not include customer-grade facility topology, detailed assumptions, optimization logic, validation thresholds, equipment mappings, customer data, or the complete evidence and review structure used in a scoped assessment.
Power Yield is a FusorX beta product concept and internal metric. It is not represented as an established industry standard, engineering certification, regulatory approval, or substitute for requirements adopted by operators, authorities having jurisdiction, standards bodies, equipment manufacturers, insurers, or qualified professionals.
3. Decision support, not engineering certification
The website and public sample are decision-support materials only. They do not certify electrical, mechanical, thermal, structural, fire, life-safety, cybersecurity, reliability, commissioning, contractual, insurance, or regulatory compliance. They do not replace a data-center operator's procedures, change-management process, equipment requirements, or review by appropriately qualified professionals.
The public sample does not perform or represent a complete electrical load-flow study, short-circuit study, protection-coordination study, arc-flash analysis, Computational Fluid Dynamics analysis, hydraulic analysis, structural analysis, fire or life-safety assessment, commissioning process, equipment warranty review, or another project-specific engineering study.
4. No material decision based solely on the public sample
Do not use the public sample alone as the basis for installing servers, increasing rack density, changing redundancy settings, modifying Uninterruptible Power Supply or power-distribution equipment, changing cooling setpoints, adding liquid-cooling equipment, purchasing retrofit hardware, committing capital, representing capacity as available to a customer, or making another material operational or commercial decision.
Any real-world deployment or retrofit should use verified facility information and the operator's required engineering, safety, commissioning, cybersecurity, warranty, contractual, and change-management processes.
5. Estimates, assumptions, and uncertainty
Terms such as “deployable capacity,” “usable capacity,” “headroom,” “stranded capacity,” “binding constraint,” “capacity unlocked,” and similar outputs refer to modeled estimates based on the inputs, assumptions, constraints, evidence, and scope available to the relevant analysis. They are not guarantees that a facility can safely, contractually, or continuously support a particular load.
Incomplete telemetry, undocumented equipment changes, transient conditions, maintenance states, environmental conditions, utility limitations, customer-specific requirements, equipment derating, control settings, cybersecurity restrictions, and other factors can materially change an estimate.
6. Beta status and product statements
FusorX is in private beta. Public descriptions of planned or beta capabilities describe product direction and intended workflow, not a warranty that every feature is generally available, independently validated, suitable for a particular facility, or capable of producing a particular result. Quantitative sample values shown on the public site are synthetic unless expressly identified otherwise.
7. Inquiry submissions and confidentiality
Visitors may use the website form to request information or discuss a potential design-partner, pilot, commercial, investment, or strategic relationship. A public-form submission does not by itself create a client, engineering, advisory, fiduciary, partnership, employment, investment, attorney-client, or confidential relationship. Do not submit confidential or sensitive information unless FusorX has first agreed in writing to an appropriate secure process and confidentiality terms.
8. Electronic communications
FusorX may respond to a communication that a visitor requests through the inquiry form. Bulk or recurring promotional electronic messages will not be activated from the public form unless the applicable consent, sender-identification, contact-information, recordkeeping, and unsubscribe requirements have been configured. Privacy and accessibility requests do not require promotional consent.
9. Acceptable use
Users may not disrupt the service, bypass or attempt to defeat access controls, introduce malicious code, unlawfully access another person's data, overload the site in a harmful manner, submit fraudulent or unlawful content, interfere with security monitoring, reverse engineer protected components except where law expressly permits it, or use the site in violation of law or third-party rights.
10. Intellectual property
The FusorX name, logo, visual identity, software, Power Yield product concepts, interface, text, graphics, model structure, and other proprietary materials are owned by or licensed to the operator of FusorX. Form submitters retain rights in their own submitted content but permit FusorX to use that content to review and respond to the inquiry, administer the requested relationship, prevent abuse, and meet legal obligations.
11. Availability and changes
The website and public sample may be changed, suspended, reset, restricted, or withdrawn at any time. Features, sample outputs, product scope, internal metrics, roadmap statements, and access conditions may change without creating an obligation to deliver a particular product, feature, date, capacity result, or commercial term.
12. No warranties
To the maximum extent permitted by applicable law, the public website, form, and synthetic sample are provided “as is” and “as available,” without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, engineering sufficiency, or suitability for a particular facility or deployment. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, FusorX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost opportunity, project delay, equipment damage, outage, data loss, capacity shortfall, or decisions made using the public website or synthetic sample. These public terms do not establish the liability allocation for paid services or pilots; those matters must be addressed in the applicable written customer agreement. Nothing in these terms limits liability that cannot lawfully be limited.
14. Privacy, accessibility, and security
Use of personal information submitted through the public site is described in the Privacy Notice. Accessibility information and the barrier-reporting process are described in the Accessibility Statement. The public form is not a secure data room and must not be used for sensitive facility information.
15. Governing law and non-waivable rights
To the extent permitted by applicable law, these public-site terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Any mandatory consumer, privacy, accessibility, competition, electronic-commerce, or other rights that cannot legally be waived remain unaffected. Subject to such mandatory rights, disputes arising solely from use of the public website or synthetic sample may be brought before courts of competent jurisdiction in Ontario.
16. Severability and entire public-site terms
If a provision of these terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms, together with the Privacy Notice and Accessibility Statement where relevant, form the terms applicable to the public website and synthetic sample. A signed customer, pilot, confidentiality, or data-processing agreement controls over these public terms to the extent of a direct conflict for that engagement.
